Nova — Terms of Service

1. Acceptance of Terms

By accessing or using Nova ("the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("User") and Nova ("we", "us", "our").

2. Eligibility — 18+ ONLY

• No minors. Users under 18 years of age are strictly prohibited from using this Service.
• You must have the legal capacity to enter into a binding agreement in your jurisdiction.
• By using the Service, you confirm under penalty of perjury that you are at least 18 years old.
• If we have reason to believe a user is under 18, their account will be immediately terminated and reported to the appropriate authorities if applicable.

3. Account Registration & Identity

• You must create an account using a valid email address or Google account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate, current, and complete information during registration.
• One person may only create one account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Prohibited Conduct

You agree NOT to use Nova for:

• Any illegal activity, including but not limited to fraud, harassment, threats, or distribution of illegal content.
• Harassment, bullying, or abuse of any kind towards other users.
• Sharing, distributing, or soliciting child sexual abuse material (CSAM) or any content involving minors — this will result in immediate account termination and report to law enforcement.
• Sharing sexually explicit content without the other party's explicit consent.
• Hate speech, threats of violence, or incitement to harm based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
• Impersonation of any person or entity.
• Spamming, phishing, or distributing malware.
• Attempting to circumvent security measures, logging, or identity verification.
• Using bots, scripts, or automated tools to access the Service.
• Recording, screenshotting, or distributing conversations without the other party's consent.

5. Data Collection & Privacy

We collect and store the following data for legal compliance and user safety:

• Identity information: Email address, name (if provided via Google), authentication method.
• IP addresses: Recorded on every connection, match, and significant action.
• Activity logs: Login, connect, match, skip, and disconnect events are logged with timestamps.
• Terms of Service acceptance: Timestamp, IP address, and version accepted.
• User agent: Browser and device information.

We do NOT store, read, or have access to your chat messages. All messages are transmitted peer-to-peer via WebRTC and never pass through our servers.

6. Cooperation with Law Enforcement

• We will cooperate fully with law enforcement agencies in response to valid legal requests (subpoenas, court orders, warrants).
• If illegal activity is reported or detected, we may share your identity information, IP logs, and activity logs with relevant authorities.
• We may report suspected illegal activity to law enforcement proactively, particularly in cases involving harm to minors or threats of violence.

7. Chat Content & Liability

• Nova is a peer-to-peer platform. We do not control, monitor, or moderate the content of conversations.
• You are solely responsible for the content you share during chats.
• We are not liable for any harm, loss, or damage resulting from your interactions with other users.
• You chat with strangers at your own risk.

8. Reporting & Safety

• Users can report others during a video chat for harassment, inappropriate behaviour, suspected underage use, spam, or illegal activity.
• Reports are reviewed by our team. Users who receive multiple reports may be automatically suspended.
• Abuse of the reporting system (false reports) may result in your own account being suspended.
• If you encounter illegal activity (especially involving minors), please report it immediately. We are obligated to report such content to NCMEC and/or local law enforcement.

9. Advertising

• Nova displays third-party advertisements (via Google AdSense) to support the free operation of the Service.
• Ad providers may use cookies and tracking technologies to serve relevant ads. This is governed by the respective ad provider's privacy policy.
• We do not control the content of third-party advertisements and are not responsible for any products or services advertised.

10. Your Data Rights (GDPR / CCPA)

• Right to Access: You can download all your personal data at any time from your account settings.
• Right to Deletion: You can delete your account and all associated personal data at any time. Anonymised audit logs may be retained for the legal retention period.
• Right to Rectification: You can update your nickname and profile information at any time.
• Right to Object: You can stop using the Service and delete your account at any time.

11. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, Nova and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

13. Account Termination

• We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms.
• You may delete your account at any time from your account settings or by contacting us.
• Upon termination, your personal data will be deleted. Anonymised audit logs may be retained for the legal retention period.

14. Modifications to Terms

• We may modify these Terms at any time. Changes will be effective immediately upon posting.
• If we make significant changes, you will be required to re-accept the updated Terms before continuing to use the Service.
• Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service operator resides, without regard to conflict of law principles.
